Tecfidera (dimethyl fumarate): the clock that blocks generics when the patent cannot

Published 24 October 2026 · Last reviewed 24 October 2026 · MPA Business Services

The Court of Justice upheld the EMA's view that Tecfidera was not covered by the same global marketing authorisation as the older product Fumaderm, so Tecfidera's own eight-plus-two years of regulatory protection applied and generic applications could not proceed until it expired, patent position notwithstanding.

What was decided

Europe gives a new medicine eight years of data exclusivity and a further two years of market protection from its first authorisation in the EU. A generic cannot even file for the first eight years and cannot be sold until ten have passed. The catch is the “global marketing authorisation”: if a product is only a variation of something already authorised to the same company, it does not get a new clock; it shares the old one.

Fumaderm, a psoriasis medicine containing dimethyl fumarate with other fumarate salts, had been authorised in Germany since 1994. When the EMA authorised Biogen’s Tecfidera (dimethyl fumarate alone) for multiple sclerosis in 2014, it had to decide whether Tecfidera was a new product with its own protection or part of Fumaderm’s global authorisation, in which case the protection would long since have run out. The EMA and Commission treated it as new. Polpharma applied for a generic in 2017 and was refused.

The General Court sided with Polpharma in 2021. On 16 March 2023 the Court of Justice set that aside: the EMA and Commission had been entitled to conclude, on the scientific assessment before them, that the two products were different, so Tecfidera’s own protection stood. Generic dimethyl fumarate had to wait for it to expire.

Timeline

Date Event
1994 Fumaderm authorised in Germany
30 January 2014 Tecfidera authorised centrally
2017–18 Polpharma’s generic application refused; Polpharma challenges the refusal
5 May 2021 General Court annuls the refusal
16 March 2023 Court of Justice sets the General Court’s judgment aside
2022–24 Tecfidera’s data exclusivity and then market protection expire; generic entry follows (dates to be confirmed)

What it means if you are…

A generics or launch planner. The three clocks run independently: patent and SPC, data exclusivity, market protection. A clear patent position is worth nothing if the regulatory clock is still running, and whether it is running can turn on a question as technical as whether two fumarate products are “the same”. Check the first EU authorisation date and the global-authorisation position before the patent search, not after.

A parallel trader. Regulatory protection does not stop parallel trade in the originator’s own product, but it does mean no generic alternative appears in any EU market until the clock runs out, so the price differentials you are working with are between national prices of the brand, not between brand and generic.

A wholesaler or buyer. When a product’s patents look weak but no generic appears, the explanation is often this clock. It is public information, held by the EMA and the national agencies, and it sets a hard date.

Status and what to watch

Settled. The same question arises whenever an old active substance is re-authorised for a new use or in a new form, and the EU pharmaceutical reform adopted in 2026 changes the lengths of these periods for products filed after it applies, expected from late 2028.
